5. Lawful bases for processing

Where ConnectProtect acts as a controller under applicable data protection law, including the UK GDPR and EU GDPR where applicable, we rely on one or more lawful bases depending upon the circumstances.

These may include:
Performance of a contract – where processing is necessary to enter into or perform a contract with you.

Legitimate interests – where processing is necessary for our legitimate business interests or those of a third party, provided those interests are not overridden by your rights and interests. These interests may include operating and securing our business, providing and improving our services, managing customer relationships and preventing fraud or cyber threats.

Legal obligation – where processing is necessary to comply with a legal or regulatory obligation.

Consent – where applicable law requires us to obtain your consent. Where processing is based on consent, you may withdraw that consent at any time.

Where ConnectProtect acts as a processor, the relevant customer, as controller, is responsible for determining the lawful basis for processing.

6. Cookies and Google analytics

Our website uses cookies and similar technologies to operate the website and understand how visitors use it.

We use Google Analytics to collect information about website usage, such as pages visited, interactions with the website, general device and browser information and traffic sources. This information helps us understand how our website is used and improve its performance and content.

Where required by applicable law, analytics cookies will only be placed after you have provided the appropriate consent through our cookie controls.

You can withdraw or change your cookie choices through the cookie controls available on our website. You can also configure your browser to block or delete cookies, although doing so may affect certain website functionality.

7. Sharing personal data

We do not sell personal data.

We may share personal data where necessary with:

  • other organisations where you have authorised the disclosure or where disclosure is
    otherwise permitted by law.

When delivering services as a processor, ConnectProtect may engage authorised sub-processors to perform specific processing activities on our behalf.

We require sub-processors handling customer personal data to be subject to appropriate data protection and security obligations.

Our service providers include organisations providing cloud infrastructure, case management, customer relationship management, privileged access management, communications, analytics and cybersecurity services.

Where required under our customer agreements, customers are notified of changes to authorised sub-processors and may exercise applicable contractual rights relating to those changes.

8. International data transfer

ConnectProtect and its service providers may process personal data in more than one country.

Our current SOC/MXDR production arrangements are designed so that customer security data is processed within the United Kingdom and/or European Economic Area (EEA), according to the applicable service and sub-processor.

Other categories of personal data processed by ConnectProtect may be transferred internationally where necessary for our business operations or provision of services.

Where personal data is transferred to a country that is not recognised under applicable data protection law as providing an adequate level of protection, we use an appropriate lawful transfer mechanism where required.

Depending on the applicable law and circumstances, these safeguards may include:

  • adequacy regulations or adequacy decisions;
  • the European Commission's Standard Contractual Clauses;

We may also implement supplementary technical and organisational measures where appropriate to protect transferred personal data.

  • identity and access management;
  • role-based and need-to-know access;
  • multi-factor authentication;
  • encryption and secure communications;
  • network security;
  • monitoring and security alerting;
  • segregation of customer information;
  • vulnerability and patch management;
  • physical security;
  • security policies and procedures;
  • employee security awareness and training;
  • incident response; and
  • secure data destruction.

Access to customer personal data is limited to personnel and service providers who require access for legitimate purposes and who are subject to appropriate confidentiality and security obligations.

10. Data retension

We retain personal data only for as long as reasonably necessary for the purposes for which it was collected, including satisfying legal, regulatory, contractual, accounting and reporting requirements.

Retention periods vary depending upon the nature of the information and the services involved.

For SOC, MXDR and managed cybersecurity services:

  • information required to establish and operate a customer's service is generally retained
    for the duration of the applicable subscription or agreement;
  • operational security and log data is retained for the retention period purchased or otherwise agreed with the customer; and
  • incident and investigation information may be retained according to the applicable
    customer agreement, service configuration, documented customer instructions and
    legal requirements.

At the end of the applicable service, customer personal data will be returned or securely deleted in accordance with our contractual obligations and applicable law.

Where deletion is not immediately possible or continued retention is legally required, we will continue to protect the information and restrict further processing as appropriate.

If we receive a request relating to personal data for which one of our customers is the controller, we may refer or forward the request to that customer as appropriate. We will provide reasonable assistance to our customer in fulfilling its obligations where required by applicable law and our contractual arrangements.

12. Personal data breaches

ConnectProtect maintains processes for identifying, investigating, containing and responding to security incidents involving personal data.

Where ConnectProtect acts as a processor and becomes aware of a personal data breach affecting customer personal data, we will notify the relevant customer without undue delay and provide reasonable assistance and available information to help the customer fulfil its obligations under applicable data protection law.
